However, making provisions for your loved ones doesn’t just stop with the financial side of things, for parents of young children it is vital to consider whom you would like to look after your children and be responsible for their well being should something happen to you.
Guardianship is something that every parent should take time to contemplate. Guardians can be friends, or family or any person(s) over the age of 18 whom you would trust to look after your children in the event of your death and they will be responsible for the child’s health, welfare and education. Guardians appointed by Will acquire parental responsibility automatically on the passing of the active parent’s death (where there are no living persons whom already has parental responsibility). Where a guardian is appointed by Will there is no need to apply to the court in order to be permitted to care for the child. Failing to appoint a guardian for your minor child(ren), means that the Courts will select a guardian for your little ones, and could result in family disputes or your children being placed with someone that you would not have intended.
Legally appointed guardians and those with special parental responsibility should also make provisions within their Wills for children within their custody, not just direct biological parents. For example, any grandparents who may have been appointed as guardians for their minor grandchildren should think about who they would like to choose to be responsible for the children they have guardianship over in the event of their passing.
Same sex couples with children are also strongly advised to take some time to think about guardianship in order to safeguard their wishes for their children’s upbringing. For families containing parents who do not have automatic legal status with the children it is vital to make provision within Wills to protect the position regarding minor children.
For unmarried partners in particular, it may be worth making provision within your Wills for guardianship as the child’s father may not automatically have parental responsibility and they will therefore need to be appointed under the mother’s Will.

Appointing your nominated guardians within your Will allows you to set out clearly your intentions regarding the upbringing and care of your little ones and can be done by setting up a Will which contains your specific directions regarding your children. This can be done during a stress-free appointment within your own home and is a simple way to put your mind at ease concerning your children’s welfare.
